Colorado Senate Bill 25-003: A Totalitarian Assault on Your Second Amendment Rights

Written by Scott James

Colorado Senate Bill 25-003 is a tyrannical assault on Second Amendment rights. This unconstitutional bill criminalizes law-abiding citizens, destroys local gun businesses, and imposes unfunded mandates on county sheriffs. Governor Polis must veto this disastrous legislation. Colorado deserves better than radical overreach and anti-gun extremism. Veto SB25-003!

The radical, unconstitutional travesty known as Colorado Senate Bill 25-003 has landed on Governor Polis’ desk, awaiting his signature. Passed by the Colorado General Assembly on March 28, 2025, this bill is nothing short of a declaration of war on the God-given and constitutionally protected rights of every law-abiding Coloradan. If Polis signs this monstrosity into law—or, heaven forbid, lets it become law without his signature—it will fundamentally alter Colorado’s landscape, turning our beautiful state into a totalitarian nightmare.

SB25-003 is exactly the type of authoritarian overreach that prompted me to start taking positions on legislation on this very website. Enough is enough. It’s time to raise our voices loud and clear.

What’s In This Unconstitutional Garbage?

SB25-003 targets and bans the manufacture, distribution, transfer, sale, and purchase of most semiautomatic firearms—specifically those with a detachable magazine or gas-operated mechanisms. It’s a blanket assault on the most commonly owned and lawfully used firearms in Colorado.

According to the bill, “specified semiautomatic firearms” include semiautomatic rifles, shotguns, and gas-operated handguns with detachable magazines. Even with supposed exemptions, the net is cast so broadly that this legislation criminalizes ordinary Coloradans for possessing common firearms. And let’s be clear—this isn’t about safety, it’s about control.

The bill imposes a Class 2 misdemeanor for first-time violations and escalates to a Class 6 felony for repeat offenses. Imagine becoming a convicted felon simply for exercising your constitutional rights. And if you’re a gun dealer? Prepare to lose your livelihood—SB25-003 allows the state to revoke your license for non-compliance.

A Bureaucratic Nightmare and an Unfunded Mandate

As if criminalizing common firearm ownership wasn’t bad enough, SB25-003 forces county sheriffs to conduct costly background checks and administer time-consuming safety courses—all without providing them any additional funding. It’s estimated that implementing this monstrosity will cost $1.4 million in the first year and $500,000 annually thereafter. Where will this money come from? The pockets of hardworking Coloradans—just another unfunded mandate shoved down our throats.

What about gun store owners? This bill outlaws the sale of the most common firearms in the state. This isn’t regulation; it’s an attempt to run gun dealers out of business. SB25-003 will force many gun stores to either shut their doors or leave Colorado altogether.

Once Again, the Colorado Legislature Places Our Second Amendment Rights Under Siege

It’s important to understand what’s happening here. This bill isn’t just unconstitutional—it’s tyrannical. The Second Amendment clearly states, “the right of the people to keep and bear Arms, shall not be infringed.” What part of “shall not be infringed” do these gun-grabbing Democrats not understand?

SB25-003 represents one of the most restrictive gun licensing systems in the United States. And if we allow this insanity to become law, there’s no telling what they will try to restrict next.

Why Governor Polis Must Veto SB25-003

Governor Polis has ten days to either sign SB25-003 into law or let it become law by doing nothing. This bill is so egregious, so unconstitutional, that it would be a dereliction of his duty as Governor of Colorado to let it pass. But here’s the catch—he can veto it. And he must veto it.

Governor Polis has previously expressed support for protecting individual liberties and has shown some reluctance to engage in outright gun bans. Now is the time for him to prove it. He has a chance to stand up for Colorado’s gun owners, business owners, and every law-abiding citizen who believes in the sanctity of the Constitution.

If Polis wants to show that he’s a Governor for all Coloradans—not just the radical anti-gun left—he will veto SB25-003.

Weld County Takes a Stand Against SB25-003

The Weld County Board of Commissioners will be considering a resolution at our meeting tomorrow, April 7, 2025, urging Governor Polis to veto this disastrous legislation. I will be voicing my overwhelming support for this resolution, because I refuse to stand idly by while our rights are trampled under the false banner of “safety.”

Our resolution explicitly states that SB25-003 will harm law-abiding citizens, devastate local gun businesses, and place an unbearable financial burden on county sheriffs who are forced to implement these pointless regulations. We are calling on Governor Polis to do the right thing and veto this disgraceful bill.

An Encouragement to Governor Polis

Governor Polis, if you’re listening, here’s what you need to know: Colorado is watching. The country is watching. Vetoing SB25-003 isn’t just the right thing to do—it’s the only thing to do.

Veto this bill because it’s unconstitutional. Veto it because it’s an unfunded mandate. Veto it because it’s an assault on law-abiding citizens and their God-given rights.

If you sign SB25-003, or let it pass without your signature, you will be remembered as the Governor who destroyed the Second Amendment rights of Coloradans. But if you stand up and veto this insanity, you will prove that you are willing to stand up to your own party for the good of the people.

I hope you hear – en masse – from the good people of Colorado. Your office number is 303-866-2471. I hope it rings non-stop until you veto this legislation.

It’s your choice. And you have less than ten days to make it.
