Senate Bill 25-034: Voluntary Do-Not-Sell Firearms Waiver

Senate Bill 25-034 creates a dangerous “voluntary” gun ban database that invites future abuse and government overreach. This bill is a Trojan horse for gun control. We must protect the Second Amendment and say NO to more government intrusion. Tell your legislators to VOTE NO on SB25-034!

Senate Bill 25-034, misleadingly titled the “Colorado Voluntary Do-Not-Sell Act”, establishes a government system for individuals to voluntarily waive their right to purchase a firearm​.

This bill:

  • Creates a new online portal for individuals to electronically file a voluntary waiver prohibiting themselves from purchasing a firearm​.
  • Requires the Colorado Bureau of Investigation (CBI) to deny any firearm transfer to individuals under a voluntary waiver​.
  • Allows third-party contacts to be notified if someone on the waiver list tries to purchase a firearm​.
  • Places the waiver into the National Instant Criminal Background Check System (NICS) and other federal databases​.
  • Subjects individuals who attempt to purchase a firearm while under a waiver to a civil infraction and a fine​.

On its face, the bill claims to address mental health and suicide prevention. But in reality, it opens the door to government overreach, backdoor gun control, and future abuse under the guise of “voluntary” action.

My Thoughts on the Bill

Make no mistake—Senate Bill 25-034 isn’t just about protecting vulnerable people. It’s about laying the foundation for an unconstitutional gun control regime built on emotion instead of rights.

Once the infrastructure for “voluntary waivers” is in place, what’s to stop lawmakers from expanding it to “involuntary waivers”? How long before your name is added without your consent, based on bureaucratic decisions about your mental health or political views?

We must oppose any legislation that normalizes government involvement in the deprivation of Second Amendment rights—voluntary or not.

Why SB25-034 Must Be Stopped

Sets a Dangerous Precedent – Normalizing “voluntary” gun bans will inevitably lead to “mandatory” bans.

Backdoor National Gun Registry – This bill uploads waiver information into NICS and other databases.

Infringes on Privacy Rights – Notifying third parties about private firearm decisions is a gross violation of individual liberty.

Enables Future Government Overreach – Once the database exists, it’s a short step to abuse by future administrations.

Enough is Enough: Protect Our Second Amendment!

This is a slippery slope to permanent gun confiscation, government monitoring, and loss of fundamental freedoms.
